Catania, Mahon & Rider, PLLC is pleased to report on the successful jury verdict obtained by Senior Associates Mark L. Schuh, Esq. and Lia E. Fierro, Esq.
The Plaintiff claimed that she fell on a patch of ice in the parking lot of a school within the Defendant School District while walking her dog. She testified that she never saw the ice, but felt it with her gloved hand after she fell. The District submitted proof that the Plaintiff stated to her husband, immediately after the fall, that she fell while she was getting her dog into, or out of, her car. Testimony by the District’s former Director of Facilities and Operations, and the Principal of the school in question, confirmed the dates, times and methods of their respective inspections of the premises at issue. The District further offered custom and practice evidence to demonstrate their diligence in ensuring the grounds were safe for pedestrian travel on the date of the incident.
After a three-day trial, the jury returned a unanimous verdict in favor of our client, after only 15 minutes of deliberation.
